Is this a joke?

I saw the brief that HME News put out on Rotech (Rotech has proof of insolvency, HME Newswire). Is this just the biggest slap in the face you can have for the competitive bidding process? You were supposed to be financially stable to be included, and these jokers admit to not even being able to pay their creditors and file bankruptcy, but they get bids all over the country anyway. I think I just threw up in my mouth.
Is something like this not the poster child for a joke of a program?
