Is there hope?
It turns out the medical lab industry has sued Medicare to stop competitive bidding for lab tests (The agency currently pays set rates for the tests). In its lawsuit, the industry argues competitive bidding would affect patient care. Sound familiar?
Here's the kicker: A federal judge yesterday (April 8) agreed to grant a preliminary injunction in the case, effectively delaying Medicare's plans to test competitive bidding for lab tests in San Diego County. The WSJ's blog includes a link to the judge's 19-page ruling.
A provider e-mailed me: "Lab services cannot be as service intensive as DME/respiratory care. This must give us some precedent for action."
I'd say so.
