The Affordable Care Act includes the 60-day overpayment rule that requires DME suppliers to refund overpayments within 60 days of identification. What many suppliers are not aware of is that if an overpayment is identified, either internally or externally, suppliers are mandated by law to perform a six-year lookback audit. If suppliers do not comply with this rule, they are at risk for false claim penalties. This webinar will (i) discuss the 60-day overpayment rule and the six-year lookback obligation; (ii) discuss steps that suppliers can take to reduce the risk of being subjected to the 60-day overpayment rule; and (iii) set out the steps the supplier should take to successfully fulfill its obligations under the rule.

On April 26, 2023, with the end of the COVID-19 Public Health Emergency (PHE) just weeks away, CMS issued a round of FAQs to set stakeholder expectations for expiring pandemic-era policies. While the document covers a wide range of topics, only a handful of the questions address key issues on the minds of DME suppliers.

Then on April 28, 2023, the DME MACs followed up with claim submission instructions related to the continued use of the CR modifier.

With so much happening at the proverbial eleventh hour, suppliers don’t have a lot of time to:

  2. Reason through the remaining unknowns, and
  3. Develop an effective action plan to protect themselves.

Since Medicare proposed its massive overhaul of national oxygen coverage in 2021, the DME supplier community has been clamoring for answers.

There were the procedural questions unanswered by CMS’s National Coverage Determination (NCD), not to mention unreconciled differences between the revised NCD and existing claim processing logic.

And now that we have the recently published Local Coverage Determination (LCD) and related policy article, we thought we might be able to simply call it case closed, a formality to fill in those procedural gaps.

It’s not quite as straightforward as we hoped.

In its recent proposal to modify the national coverage policy for home oxygen use, CMS extends coverage beyond beneficiaries suffering from documented chronic lung disease. In addition to increasing access to patients suffering from other types of respiratory distress, the changes could finally synchronize reimbursement policy with prescribing physicians’ determinations for medically necessary treatment.

On the other hand, changing nearly two decades of procedure and habit is bound to raise some issues:

  • How do suppliers distinguish between chronic and acute patients for proper billing?
  • How do proposed documentation changes affect audit risk?
  • Do the proposed changes increase administrative costs?

In this session, Andrea will tackle the questions above by exploring:
